1) Booking & Contract Formation

By making a booking, the renter submits a binding offer.

The contract is formed upon the landlord’s booking confirmation (text form is sufficient).

The rental agreement (if sent/accepted separately) is part of the contractual relationship.

The rental agreement provided to the renter must be signed by the renter within the deadline and returned to the landlord. The signed rental agreement is binding. If the signed rental agreement is not received by the deadline, the landlord is entitled to cancel the booking subject to fees in accordance with the cancellation policy.

2) Payment Terms

Deposit: 30% of the rental price due at booking.

Balance: 70% due no later than 60 days prior to arrival.

Payment by credit card or bank transfer; within 14 days prior to arrival, credit card only may apply.

Bank/transfer fees are borne by the renter. Payments are deemed made only upon receipt of funds.

3) Prices, Fees, Taxes

The prices shown in the booking confirmation apply.

Mandatory fees (e.g., departure cleaning) and optional add-on services are shown separately.

Applicable taxes are shown and calculated in accordance with legal requirements.

4) Arrival / Departure / Access

Check-in: from 4:00 PM, unless otherwise agreed. Access (e.g., code/key safe/smart lock) will be provided in a timely manner prior to arrival.

Check-out: by 10:00 AM, unless otherwise agreed.

The renter must inspect the property within 24 hours after arrival and report any defects/damage (photo recommended).

5) Damage Waiver / Damages

If shown in the booking, a mandatory damage waiver must be paid.

This covers accidental damage up to the coverage limit stated in the rental agreement, provided the damage is reported no later than at departure.

Not covered are, in particular, intentional damage, gross breaches of duty, and damage exceeding the coverage limit.

The renter is liable for damage caused by the renter, traveling companions, or visitors beyond normal wear and tear.

6) Cancellation / Refunds / Changes

Cancellations must be submitted in writing to [email protected].

The following cancellation fees apply (unless otherwise specified in the rental agreement/booking confirmation):

  • 60 days or more prior to arrival: 30% of the invoice amount

  • within 60 days prior to arrival: no refund

In the event of an evacuation ordered by authorities (e.g., hurricane), the unused portion will be refunded minus processing fees (if already paid and to the extent permitted).

Changes to a confirmed booking are—if possible—subject to a fee (€150 per contract amendment).

Recommendation: purchase travel insurance.

7) House Rules (Noise / Parties / Neighborhood)

Quiet hours: 10:00 PM – 7:00 AM. Loud music/parties, disruptive noise, and loud vehicles must be avoided.

Parties/events are prohibited. In case of violations, the landlord may terminate the stay early; a refund is excluded—to the extent permitted.

Neighbors and the neighborhood must be respected; local regulations must be followed.

8) Prohibited Substances

Illegal substances are prohibited. Legal requirements (e.g., underage possession of alcohol) must be complied with. Violations may result in immediate termination of the stay (to the extent permitted).

9) Smoking / Pets

Smoking inside the property is prohibited (outdoor areas only, if permitted and considerate).

Pets are only allowed if expressly stated for the respective property or confirmed in writing in advance.

10) Electricity / Utilities

Meter readings are taken at check-in and check-out.

Increased electricity consumption (usage exceeding the included electricity) will be charged at €0.17 per kWh plus 11.5% taxes.

If required, please make payment on site in cash at check-out. Upon request, the excess usage may be deducted from the security deposit.

This applies only if electricity is not included in the rental price.

11) Lost or Left-Behind Items

The landlord assumes no liability for lost/stolen/left-behind items.

Upon request, items will be returned for a €50.00 processing fee plus shipping.

Unclaimed items may be disposed of/donated/otherwise used after 30 days.

12) Unavailable Accommodation / Outages / Construction

If the accommodation becomes unavailable due to unforeseeable circumstances (e.g., force majeure), the landlord will endeavor to provide a replacement of comparable quality or refund nights not provided; further claims are excluded—to the extent permitted.

Temporary outages of individual amenities (e.g., internet, pool heater, air conditioning) generally do not entitle the renter to a refund, provided the landlord promptly arranges for repairs; mandatory rights remain unaffected.

Construction in the surrounding area is outside the landlord’s control; this generally does not give rise to any refund claims.

13) Right of Entry (Emergencies / Maintenance)

The landlord and/or service providers engaged by the landlord (e.g., cleaning, pool service, contractors) may enter the property in an emergency and for maintenance/repairs (preferably with prior notice and during normal hours). Locks may not be altered.

Safety Information

14) General Safety Rule

Use of the pool/spa, dock/seawall, outdoor areas, and any equipment provided, if applicable, is at your own risk. The renter must ensure that all traveling companions/visitors are aware of and follow these instructions.

15) Pool & Spa (Supervision / Weather / Conduct)

  • Children and non-swimmers must be supervised at all times and actively.

  • Do not use the pool/spa during thunderstorms/lightning/severe weather.

  • Watch for slippery conditions at the pool and in wet areas.

  • No glass in the pool/spa area.

16) Dock / Seawall / Water Access

  • Enter at your own risk (slip/trip hazard, risk of falling into the water).

  • Watch for sharp edges/surfaces (growth/shells).

  • Children only with supervision.

17) Outdoor Area / Palms / Nature

  • Uneven areas/loose pavers may occur—please be careful.

  • Do not stay under palm trees for extended periods (falling fronds/coconuts possible).

  • In Florida, insects/wildlife are to be expected; secure food and dispose of trash.

18) Equipment (e.g., kayak/SUP/bicycles)

  • Use at your own risk.

  • Check condition before use.

  • For watercraft: wear a life jacket; follow local rules.

Liability / Final Provisions

19) Liability

The landlord is liable without limitation in cases of intent and gross negligence, as well as where liability is mandatory by law.

Otherwise, liability is limited—to the extent permitted—to typical, foreseeable damages.

For accidents/damage in connection with the pool/dock/outdoor areas/equipment: use at your own risk; the renter is responsible for supervision and compliance with the safety rules.

20) Governing Law / Venue

To the extent permitted, Austrian law applies, excluding the conflict-of-law rules of private international law and the UN Convention on Contracts for the International Sale of Goods (CISG).

Venue for all disputes arising out of or in connection with this contractual relationship is Vienna, Austria, to the extent permitted by law.

21) Severability Clause

If individual provisions are or become invalid, the validity of the remaining provisions remains unaffected. In place of the invalid provision, a provision shall be deemed agreed that comes closest to the economic purpose.
